Privacy Policy

This Privacy Policy explains how PlanoIQ ("PlanoIQ," "we," "us," or "our") collects, uses, and shares information in connection with the PlanoIQ client portal and related services (the "Service").

This Policy covers information collected from Clients. It does not govern our relationship with field Pros, who are covered under a separate contractor agreement and data notice.

1. Information We Collect

Account information. Name, company name, business email address, phone number, and login credentials when you create an account.

Billing information. When you subscribe to a paid plan, our payment processor, Stripe, collects and stores your payment card details directly. PlanoIQ receives limited billing metadata (such as the last four digits of your card, billing address, and transaction status) but does not receive or store your full card number.

Audit and reporting data. Store names and locations, timestamps, shelf photographs, and AI-generated scoring associated with the brands and products you enroll for monitoring. Shelf photographs are captured by field Pros in publicly accessible retail store aisles.

Usage data. Log data, device and browser information, IP address, and portal activity (e.g., pages viewed, reports downloaded), collected automatically when you use the Service.

Communications. Records of support requests, emails, or other correspondence with us.

Cookies and similar technologies. We use cookies and similar technologies to operate the portal, remember preferences, and understand usage patterns. See Section 5.

2. How We Use Information

We use the information described above to:

  • Provide, operate, and maintain the client portal and shelf-audit reporting Service;
  • Process payments through Stripe and manage billing;
  • Generate AI-based shelf scoring and analytics for your enrolled brands;
  • Provide customer support and respond to inquiries;
  • Send administrative communications (billing notices, service updates, policy changes) and, where you've agreed to receive them, product or marketing communications, which you may opt out of at any time;
  • Monitor, maintain, and improve the Service, including improving the accuracy of our scoring models using aggregated or de-identified data;
  • Detect, investigate, and prevent fraud, abuse, or security incidents;
  • Comply with legal obligations.

3. How We Share Information

We do not sell your personal information.

We share information with:

  • Service providers who perform functions on our behalf, including Stripe (payment processing), cloud hosting and infrastructure providers, and analytics providers — under contracts limiting their use of your information to providing services to us;
  • Professional advisors, such as legal, accounting, or auditing firms, where necessary;
  • Legal and safety purposes, where required by law, subpoena, or other legal process, or to protect the rights, property, or safety of PlanoIQ, our clients, or the public;
  • Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

4. Shelf-Level, Category, and Benchmarking Data

Because field Pros photograph full retail shelf sections rather than isolated products, audit photography for any given store visit will typically include products and brands other than the one that requested the audit. As a result, brand- and product-level shelf content (not only aggregated or de-identified statistics) may appear in reports made available to other PlanoIQ clients, including competitors within the same category, as part of our category benchmarking, competitive visibility, or shelf-comparison products. This is a function of how shelf audits are physically captured, and is described further in our Terms of Service (Section 5).

We may also create aggregated, anonymized, or de-identified data (for example, category-wide shelf-condition statistics that do not identify a specific brand) from Service usage, and use or share that data for research, benchmarking, product development, and marketing purposes, including in published reports. Aggregated, de-identified data of this kind is not personal information and is not subject to the rights described in Section 7. Brand- or product-level shelf content is business information about your company, not personal information about an individual, and is addressed under the Terms of Service rather than the individual privacy rights in Section 7.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to keep you logged in, remember settings, and understand how the portal is used. You can control cookies through your browser settings; disabling certain cookies may affect portal functionality.

6. Data Retention

We retain account and audit data for as long as your account is active. Following termination of your account, we retain data for 3 days to allow for report export and to comply with legal, accounting, or dispute-resolution requirements, after which it is deleted or de-identified in accordance with our internal retention schedule.

7. Your Privacy Rights

Depending on your state of residence, you may have rights under applicable U.S. state privacy laws (such as the California Consumer Privacy Act, as amended), including the right to:

  • Know/access the personal information we hold about you;
  • Correct inaccurate personal information;
  • Delete personal information, subject to certain exceptions (e.g., information we must retain for legal or billing purposes);
  • Opt out of the sale or sharing of personal information — we do not sell or share personal information as those terms are defined under applicable law;
  • Non-discrimination for exercising these rights.

8. Data Security

We use administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

The Service is intended for business use by adults and is not directed to individuals under 18. We do not knowingly collect personal information from children.

10. International Users

The Service is currently intended for use by clients and Pros located in the United States. If PlanoIQ expands to support clients, Pros, or store locations outside the United States, this Policy will be updated to reflect applicable international data protection requirements before that expansion.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated policy with a new "Last Updated" date and, for material changes, provide additional notice (such as email or in-portal notice).
